Welcome to Nerdy Frames. These Terms and Conditions govern your use of nerdyframes.com and everything we offer through it. By using the site, reserving a home try-on, or placing an order, you agree to them.
These Terms include a binding arbitration agreement and a class action waiver in Section 17. They affect how disputes between you and Nerdy Frames are resolved. Please read them carefully.
In these Terms, "Nerdy Frames," "we," "us," and "our" mean Nerdy Frames LLC, which operates out of New York City and Cleveland, with a mailing address of 27300 Center Ridge Rd, # 45294, Westlake, OH 44145. "Services" means our website and everything offered through it. If you do not agree with these Terms, please do not use the Services.
We may update these Terms from time to time. The effective date at the top shows the latest version. If you continue to use the Services after changes are posted, you accept the updated Terms. When you place an order, the version of these Terms in effect at that moment governs that order.
You must be at least 18 years old to place an order. If you are between 16 and 18, you may use the Services only with the involvement of a parent or legal guardian who is at least 18 and takes responsibility for the activity. The Services are not intended for anyone under 16. The Services are offered for personal, noncommercial use and are intended for use within the United States; we ship to United States addresses only.
Some features, including checkout, require an account. Sign-in is by a code sent to your email address, so keeping that email account secure is how you keep your Nerdy Frames account secure. You are responsible for activity that happens under your account, and you agree to provide accurate and current information. Do not share your account or use someone else's.
Payments are handled by our payment processor. By placing an order, you authorize us to charge your chosen payment method for the order total. Your order is an offer to buy; it is accepted when we begin making it, and we may limit, cancel, or refuse any order before then, including orders we cannot verify, orders that appear intended for resale or distribution, orders placed with a card we cannot validate, and repeat use of a first-order discount across more than one account. Prices and availability can change, and if a pricing or listing error affects an order we may correct it or cancel and refund the order.
We do not authorize the purchase of commercial quantities and may limit the number of frames per order, per account, per card, or per address.
Our Home Try-On lets you reserve a box of frames to try at home before you buy.
To fill prescription lenses we need a valid eyeglass prescription and your pupillary distance (PD). We fill sphere from -20.00 to +20.00 and cylinder from -10.00 to +10.00 in single vision, anti-fatigue, and progressive lenses, and prism from 0.25 to 5.00 per axis. Prescriptions with cylinder of 2.00 or more, sphere of 9.50 or more, or prism are custom made from scratch in our lab, and the flat charges for that work are shown in the price breakdown before you check out.
You are responsible for the accuracy of the prescription and PD you enter or upload, and for making sure the prescription is current and valid. We make your lenses to the numbers you give us. If lenses are made correctly to an incorrect or expired prescription or a wrong PD, the remake is not a defect on our side; we will help, but a remake in that situation may carry a lens charge at our discretion.
If you order prescription eyewear without having tried our frames, your order may be canceled and refunded, so we recommend a try-on box first.
Every pair of prescription lenses is made to order for your prescription, your PD, and your frame; most of them are custom surfaced from scratch. Production begins promptly after your order is placed. Because lenses made for you cannot be resold, returns of lens upgrades and custom work carry the recycle fees described in Section 9, and custom orders may not be cancellable once production has begun.
Shipping is free on try-on boxes, purchases, and exchanges within the United States. Most orders ship within 8 to 15 business days, depending on what is ordered. Risk of loss and title pass to you when we hand your order to the carrier. If a delivery is reported as lost or damaged, contact us promptly so we can open a claim with the carrier.
Frames carry a 1-year warranty and lenses carry a 6-month warranty against manufacturing defects. Under the lens warranty we will replace lenses that scratch or warp because of a manufacturing defect once, at no charge, within 6 months of purchase; the frames must be sent to us for the replacement, which takes 10 to 14 business days. The warranties do not cover normal wear, scratches from use or cleaning, accidental damage, damage from adjustments made elsewhere, or loss. This is the only warranty we give on the products; Section 15 covers everything else.
Store credit earned through the home try-on or our introductions program is applied at checkout toward an order. It has no cash value and cannot be redeemed for cash.
All content on the Services, including frame designs, photographs, text, and the Nerdy Frames name and logo, belongs to Nerdy Frames or our licensors and is protected by law. You may not copy, reproduce, distribute, or otherwise use it without our written permission.
You agree not to interfere with the Services, scrape or harvest data, resell the Services, reverse engineer the site, introduce malicious code, place an unreasonable load on our systems, or use the Services in any way that violates the law or these Terms.
We may refuse, cancel, or limit orders and try-on reservations, decline returns, and close accounts, with or without notice, where we reasonably believe a person is abusing the Services. This includes fraud or attempted fraud, repeated returns or try-on boxes that suggest use rather than trial, filing payment disputes on charges that were disclosed and agreed to, using multiple accounts to reuse a discount, and violating these Terms. Your obligations under these Terms, including amounts owed, survive any termination.
Nothing on the Services is medical advice. Consult a licensed eye care professional for your vision needs. Product images and descriptions are provided for reference and may not be exact.
Except for the warranty in Section 10, and to the fullest extent permitted by law, the Services and products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error free, secure, or that any content is accurate, complete, or current.
To the fullest extent permitted by law, Nerdy Frames will not be liable for any indirect, incidental, special, punitive, or consequential damages, or for lost profits or data, arising out of or relating to your use of the Services or products. Our total liability for any claim will not exceed the amount you paid for the product at issue. Some states do not allow certain limitations, so some of these may not apply to you.
Please read this section carefully, because it affects your legal rights.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio, and you consent to their jurisdiction.
We process orders quickly, so we cannot guarantee changes or cancellations once an order is placed, though we will try to accommodate reasonable requests. Because lenses are made to order (Section 7), custom orders may not be cancellable once production begins. Try-on reservations can be canceled any time before the box ships.
By using the Services you agree to receive communications from us electronically, including order confirmations, shipping updates, try-on notices, account codes, and any notices required under these Terms, at the email address on your account, and you agree that these electronic communications satisfy any requirement that a communication be in writing.

Nerdy Frames LLCUnfortunately, we don't have any direct partnerships with vision insurance providers, but we can assist you in getting a reimbursement for your purchase after you have paid in full at the time of purchase. In order to be reimbursed, you will first need to fill out a form from your insurance provider. After you fill out their reimbursement form, you will need to provide an itemized receipt, which we can provide you with once you have completed your purchase. We've provided some links below of popular vision insurance providers to help you get started.

We accept both FSA and HSA payments, as long as they are in the form of a credit or debit card. After you have had completed a purchase with your FSA/HSA, you can then file for a reimbursement with your vision insurance provider.
